1. Acceptance and eligibility
By accessing or using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the website or submit information through it.
You must be at least 18 to apply, make a booking, register for a paid programme or enter into an agreement on your own behalf. A person under 18 may participate only through a parent or legal guardian who has authority to act for them.
2. Model applications and representation
- An application is a request for consideration and does not guarantee an audition, response, representation, booking or income.
- You must provide information that is accurate, current and lawfully yours to share.
- We may request verification, measurements, digitals, a casting or guardian consent before making a decision.
- Representation begins only when the authorised parties enter a separate written agreement.
- We may decline or close an application where information is incomplete, misleading, unsafe or inconsistent with current agency needs.
3. Booking enquiries, prices and cancellations
A website enquiry is not a confirmed booking. A booking becomes binding only when scope, talent, rate, usage, timing, location, payment, cancellation and any travel requirements are confirmed in writing by BrightQuests and the relevant parties.
- Quotes are based on the information supplied and may change if the brief, usage, duration, territory or production requirements change.
- Clients must not use talent images, names or performances beyond the usage and period confirmed in writing.
- Reasonable cancellation or postponement charges may apply after confirmation, particularly where talent time or production resources have been reserved.
- Any non refundable or restricted term will be brought to the customer's attention before the transaction is concluded.
- Nothing in these terms removes rights or remedies that cannot lawfully be excluded under the Federal Competition and Consumer Protection Act 2018 or other applicable law.
4. Website content and intellectual property
The website design, agency name, text, graphics, photographs, videos, model profiles and other materials are owned by BrightQuests, its talent, photographers, clients or licensors. They are protected by applicable intellectual property and personality rights.
You may view and share links to public pages for ordinary personal or editorial reference. You may not copy, download, scrape, train a model on, publish, sell, alter, impersonate, advertise with or commercially exploit website content without prior written permission from the relevant rights holder.
Material you submit
You retain ownership of material you submit. You give BrightQuests a limited permission to receive, store, review, organise and share it internally, and with relevant decision makers, only for the application, booking, event or service you requested. Any public portfolio or promotional use requires the applicable consent or agreement.
You confirm that you have the right to submit the material and that it does not infringe another person's rights, privacy or confidentiality.
5. Acceptable use
You must not:
- Use the website for fraud, harassment, exploitation, unlawful discrimination or any unsafe activity.
- Submit malicious code, interfere with security, probe restricted systems or attempt unauthorised access.
- Harvest personal data, copy talent profiles in bulk or contact talent in a way designed to bypass the agency.
- Misrepresent your identity, authority, project, budget, usage rights or relationship with BrightQuests.
- Use automated tools in a way that creates unreasonable load or ignores published technical restrictions.
6. Accounts and restricted areas
Staff, talent and administrative areas are restricted. You are responsible for keeping account credentials confidential and for activity carried out through your account. Notify us promptly if you suspect unauthorised access. We may suspend access to protect people, data, operations or the website while a concern is investigated.
7. Website information, links and availability
We aim to keep public information accurate and the website available, but portfolios, availability, event details and opportunities may change. Website content is general information and is not a promise of work, placement, earnings or continuous service.
Links to third party websites are provided for convenience. We do not control their content, privacy practices or availability. Review their own terms before providing information or completing a transaction.
8. Responsibility and liability
Each party remains responsible for its own acts, statements and obligations. To the extent permitted by law, BrightQuests is not responsible for indirect loss caused solely by reliance on general website information, third party services or events outside our reasonable control.
Nothing in these terms excludes responsibility for fraud, wilful misconduct, negligence where liability cannot lawfully be excluded, breach of statutory consumer rights, or any other liability that applicable law does not permit us to limit.
If your intentional misuse of the website or knowing infringement of another person's rights causes a substantiated third party claim against BrightQuests, you are responsible for the direct loss reasonably resulting from that breach, subject to applicable law and fair process.
9. Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. The parties should first attempt to resolve a concern in good faith through written communication. If it is not resolved, the courts with appropriate jurisdiction in Lagos State may hear the dispute, without limiting a consumer's right to approach a competent regulator, tribunal or court.
If any part of these terms is found unenforceable, the remaining parts continue to apply. A delay in enforcing a right is not a waiver of that right.
10. Changes and contact
We may update these terms to reflect changes in the website, our services or legal requirements. The effective date identifies the current version. Material changes will apply from publication or from another date stated in the notice and will not retrospectively change a confirmed written agreement.
